LEGAL TERMS AND CONDITIONS FOR PARTICIPATION IN THE SOCIAL MEDIA PRIZE DRAW
(draw on Facebook and Instagram (@restauranteilPalco) of Restaurant il Palco).
1.COMPANY ORGANISING THE PRIZE DRAW
The company Colinas Green Golf S.L. (hereinafter, “the brand”) with address in C/ Luchana 23; 28010 – Madrid; organizes a prize draw (hereinafter, “the Draw”) that takes place online, in the social networks Facebook and Instagram.
The purpose of this prize draw is to raise awareness of the new Facebook profile, get new followers on this profile, reward the loyalty of the brand’s followers on Instagram, and get new follower conversions on both networks through their networks.
2. START DATE AND END DATE
The prize draw will start on 20th June 2022, and will end on 4th July 2022 at 23:59h.
3. PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION
The requirements for participation are as follows:

- – The user may participate more than once as long as he/she posts more than one comment with a mention. In each comment, the citation must be different.
- – Only Instagram and Facebook account holders are eligible to participate
- – Participants must follow the @restauranteilPalco account on Facebook and Instagram during the participation period indicated above, and comment on the publication mentioning at least two people. The mentioned profiles must be real.
- – The application will accumulate mentions of the same participant, even if they are in different comments.

4. CONDITIONS OF THE DRAW AND PRIZES
The winner will be chosen randomly via the Easypromos platform. The winner will be announced on 5th July through the brand’s Facebook and Instagram profiles, along with the certificate of validity of the prize draw.
The prize will be an experience at il Palco valued at €100.
The prize may not be exchanged for cash or any other prize, nor may it be exchanged or altered or transferred to another person.
The holding of the draw and the awarding of the prize are subject to the tax regulations in force.
Once the winner has been notified, he/she has until 31st July to claim and fulfil the prize, subject to availability. The prize may be fulfilled subject to availability at il Palco Restaurant.
If the prize cannot be fulfilled within this period, it will be declared void.
5. DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the Participants do not comply with the requirements set out in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the draw and will lose all rights to the prizes awarded by virtue of this prize draw.
6. PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or which could infringe the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honour, to personal and family privacy and to one’s own image will not be allowed. We will not be held responsible for any damage caused by comments made by Participants in the Promotion, which may at any time offend the sensibilities of other Participants.
The participation in this prize draw, as well as the publication of the comments made by the Participants in the publications may not, under any circumstances, violate the Instagram Community Rules or the Instagram Terms of Use, nor the applicable regulations and especially the right to honour, privacy and one’s own image.
7. EXEMPTION FROM LIABILITY
By way of example, but not limitation, the brand is not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the Participant with respect to the prize obtained from this Promotion.
The brand accepts no responsibility in cases of force majeure or unforeseeable circumstances that could prevent the draw from taking place or the total or partial enjoyment of the prize.
Nor does it assume the costs that may arise from the satisfaction of the prize, with respect to logistical expenses, or other expenses related to or necessary for the fulfillment of the prize.
8. PROTECTION OF PERSONAL DATA
The personal data collected will be processed by Colinas Green Golf S.L., which is responsible for the processing, to manage your participation in this prize draw. On the basis of the legitimacy of the contractual relationship that your participation in the prize draw entails. Your personal data will be kept for the duration of the management of the prize draw. Once the claim period has expired, your data will be deleted. In no case will your data be transferred to other people or used for purposes other than those indicated in this section and in these rules. However, your name and surname will be published if you are a winner, as indicated in section 4.
We inform you that you may exercise your rights of Access, Opposition, Rectification, Deletion, Portability, Limitation and Oblivion and not to be subject to automated individual decisions by sending an e-mail to privacidad@lacolinasgolf.es. You also have the right to file a complaint with the Data Protection Supervisory Authority, AEPD.
9. CHANGES AND ACCEPTANCE
We reserve the right to amend or extend these Promotional Terms and Conditions, to the extent that it does not prejudice or undermine the rights of the Participants in the Promotion.
The mere act of participating in the prize draw implies that the Participant fully accepts the conditions of these Terms and Conditions. Likewise, participation in a prize draw of this nature implies acceptance of the Instagram Community Rules through which it is carried out.
10. APPLICABLE LAW AND JURISDICTION
These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the tax address of the brand will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these terms and conditions.
